TL* THE CONTACT OWNED A 2008 GMC ACADIA. WHILE DRIVING APPROXIMATELY 55MPH IN RAINY WEATHER, THE VEHICLE HYDRO-PLANED. THE SEATBELT DID NOT RESTRAIN THE CHILD RESTRAINT AND WAS FLIPPED UPON IMPACT. THE CHILD SUSTAINED INJURIES TO THE TEMPORAL BONE CAUSING PERMANENT LOSS OF HER RIGHT EAR. THE PASSENGER SUSTAINED INJURIES TO THE NECK, RIGHT FOOT, AND HEAD. THE MANUFACTURER ADVISED THAT THE ON-STAR SYSTEM FAILED TO RECOGNIZE THAT THE VEHICLE WAS INVOLVED IN A CRASH BECAUSE THE SYSTEM COULD NOT DETECT A CRASH IN A RURAL AREA. THE CHILD RESTRAINT SEAT WAS UNDAMAGED. THE VEHICLE WAS DESTROYED. THE CONTACT LOCATE A RECALL IN WHICH HE BELIEVED AFFECTED HIS VEHICLE (NHTSA CAMPAIGN ID NUMBER: 10V375000-SEAT BELTS) AND WAS THE REASON THE SEAT BELT DID NOT RESTRAIN THE CHILD OCCUPANT. THE CONTACT DID NOT CONFIRM IF HIS VIN WAS INCLUDED. A POLICE REPORT WAS AVAILABLE. THE FAILURE AND CURRENT MILEAGE WAS 35,000.
